Sexual Harassment Is Still A Big Problem

Sexual harassment has been in the news a lot lately.  One might think that, with all the publicity, things are getting better.  That's not necessarily the case.  For example, a recent report by the National Academy of Sciences, Engineering and Medicine showcased the prevalence of sexual harassment in academia. And while the EEOC has seen a 41% drop in sexual harassment filings over the last twenty years, that doesn't mean that sexual harassment is going away.  To the contrary, an estimated 76% of non-manager employees who experienced sexual harassment did not report it, often for fear of retaliation.

So what can be done about sexual harassment in the workplace? First, companies must implement strong sexual harassment policies, including training.  Second, when receiving a report of sexual harassment, companies need to take it seriously and conduct a full investigation.  Third, and perhaps most importantly, companies need to make it clear that retaliation will not be tolerated.  A good place for companies to start would be to implement the policies set forth in the proposed EEOC Enforcement Guidance on Unwanted Harassment.
